Terms of Service
Last updated: November 1, 2026.
These terms are a contract between you and DATA EAVER INC. ("we", "us"), the developer of Tally, for use of the Tally app and website (tally.dataeaver.ca, the "Service"). By creating an account or using the Service you agree to them.
The Service
Tally lets you photograph or upload receipts, extract their details with AI, and track your spending. Features may change over time. A free tier is available; paid plans, if offered, are described at sign-up.
Your account
- You must be at least 16 years old and provide accurate information.
- You are responsible for activity under your account and for keeping your sign-in credentials secure.
- One person or entity per account unless we agree otherwise.
Your content
- You keep all rights to the receipts and data you add ("Your Content").
- You grant us a limited licence to host, process, and display Your Content solely to operate and improve the Service for you (including sending receipt images to our AI provider for extraction, as described in the Privacy Policy).
- You are responsible for Your Content and confirm you have the right to upload it.
Acceptable use
Don't: break the law; upload content you have no right to; probe, overload, or disrupt the Service; reverse engineer it except as permitted by law; resell or scrape it; or use it to build a competing product.
When you share expenses, you may write comments other people see. There is no tolerance for objectionable content or abusive users: no harassment, hate, threats, sexual content, spam, or anything else you wouldn't say to the person directly. Anyone can report a comment and block its author from the comment itself; blocked people's comments and activity are hidden from the person who blocked them. We review reports within 24 hours, remove content that breaks these terms, and may suspend or close the account that posted it.
AI output
Extraction is automated and can be wrong. Review every result before you rely on it. Tally is a personal record-keeping tool, not accounting, tax, or financial advice.
Availability
The Service is provided "as is" and "as available". We don't guarantee it will be uninterrupted, error-free, or that data will never be lost — keep your own copies of anything important.
Payment (if applicable)
Paid subscriptions renew automatically until cancelled. You can cancel any time, effective at the end of the current period. Purchases made through the Apple App Store are also governed by Apple's terms, and refunds are handled by Apple. Prices may change with notice.
Termination
You may stop using the Service and delete your account at any time (Account → Delete account). We may suspend or terminate access if you breach these terms or to protect the Service or other users. On termination your right to use the Service ends; account-deletion effects are described in the Privacy Policy.
Disclaimers and liability
To the fullest extent permitted by law, we disclaim all warranties not expressly stated here, and our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or CAD 100. We are not liable for indirect or consequential losses, including lost data or profits. Some jurisdictions don't allow these limits, in which case they apply to the extent permitted.
Changes
We may update these terms; we'll change the "Last updated" date and, for material changes, give notice in the app or by email. Continued use after changes means you accept them.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes will be handled by the courts located in Toronto, Ontario, without regard to conflict-of-laws rules. (Confirm this matches where you're actually based.)
